In 2020, a Corporate Manslaughter charge was levelled against an Employer in England following the death of two parents in a car that came into contact with a works vehicle driven by an employee who had consumed cocaine over the weekend. The Employer had a Drug & Alcohol Policy but never conducted Drug & Alcohol Testing nor did it act on any reasonable suspicion that this employee took drugs in their leisure time. The main penalty for a Corporate Manslaughter charge is an uncapped fine with recent cases ranging from anywhere between £200,000 to, in the case of a recycling company in 2017, £2 million and for large employers up to £20 million.

WORKPLACE DRUG & ALCOHOL TESTING

Our Drug & Alcohol Testing Service Includes:

Onsite Drug Testing Service:

  • Utilising the market-leading Drug-wipe Dual 5s screening device*;
  • All tests are undertaken onsite by our fully qualified testing consultants;
  • Using UKAS Accredited Laboratories all samples are handled in full compliance with the Chain of Custody procedures for analysis and results are reported against European legally defensible workplace guideline cut-off levels;
  • Results are legally defensible, protecting Employers against any potential unfair dismissal claims.

*Drug-wipe 3s is used by all 43 Police Forces across the UK and the workplace Drug-wipe 5s utilises the same chemicals and components to achieve the same reliable result.

Onsite Alcohol Testing Service:

  • Utilising the Drager Alcotest 6000, with its UK police specification sensor, we use the most sophisticated workplace breathalysers on the market;
  • All tests are undertaken onsite by our fully qualified testing consultants;
  • Our devices are recalibrated every 6-months to ensure our readings are defendable by the manufacturer in a court of law, offering further protection to Employers.

Our fully qualified testing consultants utilise a market-leading drug screening device which is non-invasive and non-intrusive. The Drug-wipe 3s is used by all 43 Police Forces in the UK, and its sister, the workplace dual Drug-wipe 5s, utilised by our qualified testers, is made of the same chemicals and components, assuring you of accurate and reliable results.

The workplace dual Drug-wipe takes under a minute to administer and 5 minutes to provide a result and is able to detect the five most prevalent drugs in the UK: Cannabis, Cocaine, Methamphetamines (Ecstasy), Amphetamines (Speed), and Opiates.

The test for drugs is undertaken by our qualified tester on your site, at a date and time that suits your operational requirements, and is non-invasive and non-intrusive, simply comprising taking a sweat and saliva sample. These samples will enable the detection of drugs from recent and longer-term use.

In the circumstance of a non-negative result, our qualified testers will arrange for an accredited confirmation collection and laboratory analysis service to attend onsite. Using UKAS Accredited Laboratories, all samples are handled in full compliance with the Chain of Custody procedures for analysis, and results are reported against European legally defensible workplace guideline cut-off levels. This Drug & Alcohol Testing service is available 24 hours a day and 365 days a year. The resultant report will provide you with a legally defensible result should you face an unfair dismissal claim.

Our fully qualified testing consultants utilise the Drager Alcotest 6000, with its police specification sensor, the most sophisticated breathalysers on the market.

The test for alcohol is undertaken by our qualified tester on your site, at a date and time that suits your operational requirements, and takes under 30 seconds to administer and provide a result.

In the circumstances of the detection of alcohol, our testers will re-administer the test after 20 minutes and this result will stand as the record for the instigation of any disciplinary proceedings.

Our devices are recalibrated every 6 months to ensure the readings are defendable by the manufacturer in a court of law, offering further protection for Employers. This is part of our comprehensive Drug & Alcohol Testing service.
